Introduction

Welcome to Silence People. These Terms of Service ("Terms") govern your access to and use of the Silence People website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

Please read these Terms carefully. If you do not agree with these Terms, please do not access or use our Services.

Eligibility

You must be at least 18 years old to use our Services independently. By agreeing to these Terms, you represent and warrant that:

  • You are at least 18 years old, or if you are between 13 and 18 years old, you have your parent's or legal guardian's permission to use the Services and they have read and agree to these Terms on your behalf
  • You have the legal capacity to enter into a binding agreement with Silence People
  • You are not prohibited from using the Services under applicable laws
  • You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations

If you are under 18 years old, you may only use our Services with the involvement and consent of a parent or legal guardian. Your parent or legal guardian will be responsible for your compliance with these Terms and must supervise your use of our Services. Some features of our Services may be restricted for users under 18 years old, even with parental consent.

Parents and legal guardians are responsible for monitoring and supervising their children's use of our Services. If you permit your child to use the Services, you are responsible for their online conduct and their compliance with these Terms.

If you are accessing or using the Services on behalf of a business or entity, you represent and warrant that you have the authority to bind that business or entity to these Terms, and that the business or entity agrees to be bound by these Terms.

Account Registration

To access certain features of our Services, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, not current, or incomplete.

Mental Health Disclaimer

Silence People provides a platform for connecting users with mental health professionals. We do not provide mental health services directly. The mental health professionals on our platform are independent providers who are solely responsible for the services they provide.

The Services are not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions you may have regarding a medical or mental health condition.

Emergency Situations: Silence People is not designed for emergency situations. If you are experiencing a mental health emergency or are at risk of harming yourself or others, please call your local emergency services (such as 911 in the United States), go to your nearest emergency room, or call the National Suicide Prevention Lifeline at 1-800-273-8255.

User Content

Our Services may allow you to upload, store, send, or receive content, including text, images, and other materials ("User Content"). You retain ownership of any intellectual property rights that you hold in that User Content.

By uploading, storing, sending, or receiving User Content through our Services, you grant us and our affiliates a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute such User Content for the limited purpose of providing the Services.

You represent and warrant that:

  • You own or have the necessary rights to use and authorize the use of the User Content as described in these Terms
  • The User Content does not violate or infringe upon the rights of any third party, including intellectual property rights, privacy rights, or publicity rights
  • The User Content complies with these Terms and all applicable laws and regulations

Prohibited Uses

You agree not to use the Services:

  • For any unlawful purpose or in violation of any applicable law or regulation
  • To harass, abuse, or harm another person, or to promote violence or discrimination against any individual or group
  • To impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
  • To attempt to gain unauthorized access to the Services, other users' accounts, or computer systems or networks connected to the Services
  • To interfere with or disrupt the integrity or performance of the Services
  • To collect or store personal data about other users without their consent
  • To transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature

Payment and Subscription Terms

Some of our Services may require payment or a subscription. By providing a payment method, you represent and warrant that you are authorized to use the payment method and that you authorize us to charge your payment method for the Services.

Subscription fees are charged in advance on a recurring basis according to the subscription plan you select. You may cancel your subscription at any time, but we do not provide refunds for the current billing cycle.

We reserve the right to change our pricing terms at any time, and such changes will apply to future billing cycles unless you cancel your subscription before the next billing date.

Intellectual Property

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Silence People, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution

Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

SILENCE PEOPLE DOES NOT WARRANT THAT THE SERVICES WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, OR THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED. SILENCE PEOPLE DOES NOT WARRANT THAT THE SERVICES ARE ACCURATE, RELIABLE, COMPLETE, USEFUL, OR APPROPRIATE FOR YOUR USE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SILENCE PEOPLE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
